Education Law TeamLAWYERS WITH PRACTICAL EXPERIENCEEmond Harnden has made Mr. Paul Marshall responsible for the team who will be providing education law services. We are proud to have in our firm a lawyer who has had practical experience with teaching.
Before studying in the French Common Law program at the University of Ottawa, Paul Marshall was a qualified teacher. He attended the Faculty of Education at the University of Moncton, where he graduated with a Bachelors degree in education in 1987. Paul completed specialized courses offered by the Ministry of Education of Ontario. He also holds a Master in Education from the University of Ottawa. Paul Marshall has developed a successful bilingual practice with an emphasis on education law and the legal aspects of school board management. As an experienced litigator, he is familiar with both common law courts and administrative tribunals. Paul is a member of the Ontario Bar Association, the Association des juristes d’expression française de l’Ontario and the County of Carleton Law Association. He is also a member of the Executive of the Ontario Bar Association - Education Law Section.
A well-known expert in the areas of education, health and technology, Lynn Harnden has in-depth knowledge of human rights, unjust dismissals and labour relations. Through his twenty-four years of practice, Lynn has acquired a vast experience of the education world. He has participated regularly in school board meetings as legal counsel on matters of labour and employment law. He has also negotiated, on behalf of school boards, with teacher and support staff unions. In addition, he has represented school boards in arbitration cases. At the national level, he is often designated the “most frequently recommended leading practitioner in labour relations and employment law” in peer surveys conducted by LEXPERT. He has been lead counsel for a number of precedent-setting cases dealing with absenteeism, disability and the privatization of public sector corporations. Lynn holds a degree in law from the University of Toronto. He is past Chair of the Human Resources Professionals Association of Ontario and of its Federal Government Affairs Committee. As a member of a Canadian delegation to Sri Lanka in 2001, he gave lectures on Canadian approaches to alternative dispute resolution.
Jennifer Birrell has extensive expertise in the public sector, municipal government and the education environment. Jennifer maintains a labour and employment law practice with a particular focus on representing school boards at labour arbitration, collective bargaining and expulsion appeals. As legal counsel and labour relations officer with an Ottawa school board, she drafted legal opinions, policies and procedures, as well as providing training programs to the employees. She also acted as main spokesperson for the school board for the negotiation and implementation of collective agreements. Her legal advice is sought on employment contracts, downsizing, policy development, human rights, labour arbitration and all aspects of the employment relationship. She has a very diverse public sector clientele. Jennifer was born and raised in Ottawa. She studied at the University of Ottawa and has been practicing law since 1995. A committed and active member of her community, she is past Chair of the Canadian Toy Testing Council. She was a featured speaker at a recent CCLA Civil Litigation Conference, and she often speaks on issues related to labour and employment law at various conferences.
Carole Piette manages an important bilingual practice with an emphasis on negotiations and labour arbitration. She represents a number of clients on issues relating to labour and employment law. Before joining the firm in 1988 as a partner, Carole worked for several years as a labour relations officer at the Association of Universities and Colleges of Canada. Since joining Emond Harnden, she has acquired a strong expertise in key areas of education law: workplace investigations, human rights, pay equity, alternative dispute resolution, mediation, representation before arbitration boards, negotiations and collective agreement interpretation. Carole chairs investigations and conducts mediation on harassment complaints in the workplace, in both the public and private sectors. She regularly offers training to employers on human rights in the workplace, and in particular on harassment issues. A graduate of the University of Ottawa, Carole is involved in the Ottawa business community. She is a member of a number of organizations, such as the Regroupement des gens d’affaires, the Women’s Business Network and the Ottawa Human Resources Professionals Association.
Sébastien is a bilingual lawyer with an in-depth knowledge of the public sector, who is particularly interested in the federal and municipal government as well as in health and education issues. A graduate of the National Program in Law at the University of Ottawa – common law and droit civil – Sébastien provides legal advice in the following areas: judicial reviews, grievance arbitrations, wrongful dismissal litigation and labour disputes. Sébastien has experience in civil litigation and mediation work in the area of wrongful dismissal and provides client seminars focusing on human rights including, discrimination, harassment, disciplinary measures and dismissal. Sébastien sits on the Board of Directors of the Académie Jeanne d’Arc. He is also a member of the Association des juristes d’expression française de l’Ontario, the Canadian Bar Association, the Regroupement des gens d’affaires, the Advocates Society and the Ottawa Human Resources Professionals Association.
