THE DUTY TO ACCOMMODATE AND MANAGEMENT OF MEDICAL INFORMATION

Employers are obligated to make workplace adjustments in order to accommodate employees with an illness or disability. The exchange of personal health information is essential for a mutually satisfactory and successful return to work/accommodation process. In order to ensure a safe return to work and to confirm the extent of an employee’s limitations, restrictions and capabilities, access to an employee’s personal health information is essential.

Our lawyers will discuss the management of medical information in employee illness and accommodation cases and will also provide a brief overview of recent accommodation cases.

Topics will include:

  • Issues of consent and an employer’s right to access medical information. How much information is enough? How much can be requested and at what stages – initial stages of sick leave, short-term disability, accommodation?

  • Practical strategies for handling inadequate medical information

  • Developing a defensible medical questionnaire

  • Review of recent accommodation cases
