This paper addresses one of the most recent examples of public-private partnering in Canada in recent years, the commercialization of the Air Navigation Service ("ANS") of Transport Canada. NAV CANADA, a not for profit corporation created under Part II of the Canada Corporations Act, R.S.C. 1970, C. 52, purchased the ANS from the federal government on October 31, 1996 for 1.5 billion dollars. Besides being one of the largest privatizations undertaken in Canada to date, whether measured in terms of the number of employees affected or the scope and complexity of operations being transferred, the NAV CANADA Commercialization offers many useful insights into the myriad of labour relations issues which arise in any large public sector devolution to the private sector.
After reviewing the successorship provisions contained within federal labour legislation, this paper examines the manner in which different privatizations have overcome legislative and policy obstacles, with particular emphasis upon the NAV CANADA Commercialization.
